This course examines the legal and technical boundaries between statutory minimum building codes and the legal Standard of Care for engineers. A broad understanding of the Standard of Care - the legal benchmark used to evaluate professional skill, performance, and negligence and the requirements of the Building Code will be identified. Through comparative analysis and real-world case scenarios, participants will explore the critical intersections and misalignments between statutory building codes and professional legal expectations. The session discusses the merits of design briefs as a critical risk-management tool to align client expectations, define technical thresholds beyond basic code, and protect design professionals from professional negligence claims.

Timothy Lynch joined Thornton Tomasetti in 2022. He brings more than 35 years of experience with 17 years spent at the New York City Department of Buildings (DOB). Prior to serving as the Chief Engineer for the Enforcement Bureau at the DOB, Tim was Assistant Commissioner for Investigative Engineering Services, where he led teams for forensic engineering, excavation, concrete, façade, and emergency response, among others. He is a recognized expert in building forensics and was involved in the development and implementation of the 2008, 2014, and 2022 New York City International Code Council (ICC) building codes, laws, and rules. His background also includes the restoration of many landmark buildings, including Carnegie Hall and New York City Hall in Manhattan and Brooklyn’s Park Slope Armory as well as the Brooklyn Academy of Music.

This presentation introduces the workflow for conducting an embodied carbon assessment, a specialized form of life cycle assessment. It will walk through the essential steps, highlight critical goal-setting and scoping considerations, and identify key decision points practitioners must navigate throughout the process. The newly released SEI Prestandard for Assessing the Embodied Carbon of Structural Systems will serve as a central reference, providing guidance and structure for the assessment approach.

Michael Lyons, PE, LFA, is the Structural Sustainability Lead at Martin/ Martin Consulting Engineers. He has 14 years of experience in the industry, focusing both on sustainability and the design of mid-rise commercial buildings. He sees embodied carbon as an exciting opportunity for the industry to develop as a design constraint. He currently serves as the Chair of SEAC's (Colorado) Sustainable Design Committee and the co-chair of the SEI Sustainability Committee. Michael currently lives in the Denver, Colorado area but grew up in Saratoga Springs, NY and received his Bachelor's and Master's degrees from RPI.

Caroline Bennett, PE, PhD, is the Charles E. & Mary Jane Spahr professor and chair of the Department of Civil, Environmental, and Architectural Engineering at the University of Kansas. Her research has addressed some of the most pressing challenges in structural engineering, including fatigue and fracture performance of steel infrastructure, constraint-induced fracture in steel bridges, and innovative structural retrofit strategies for a wide range of structures. Bennett has led national projects with the Federal Highway Administration, the National Cooperative Highway Research Program, the U.S. Army Corps of Engineers’ Engineer Research and Development Center, and several state departments of transportation, delivering solutions that extend the service life of structures and improve infrastructure performance. She serves on AISC’s Committee on Research as well as the TC10 Materials and Fabrication Committee. She recently served on AISC’s Game Changer panel. She also contributes to the American Iron and Steel Institute (AISI) Steel Bridge Task Force and Transportation Research Board committees, strengthening connections between research and practice.
